.By accessing or using Surf Academy Pro (hereafter “the Platform”), you agree to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with them. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
1. Definitions
1.1 Surf Academy Pro refers to the online coaching and educational platform owned and operated by Pepijn Tigges Surfcoaching. 1.2 Client, User, or Participant refers to any person who purchases, accesses, or uses Surf Academy Pro’s online courses, programs, or coaching services. 1.3 Materials refer to all video lessons, coaching content, guides, images, exercises, and other educational materials available through the Platform. 1.4 Coaching Services refer to any personalized online coaching, feedback, or communication provided by Surf Academy Pro representatives. 1.5 Representative refers to any authorized coach, trainer, or staff member acting on behalf of Surf Academy Pro.
2. General Conditions
2.1 By purchasing or accessing the Platform, the Client confirms that they have read, understood, and agreed to these Terms and Conditions. 2.2 Any deviations from these Terms and Conditions are valid only if confirmed in writing by Surf Academy Pro. 2.3 Surf Academy Pro reserves the right to update or modify these Terms and Conditions at any time. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
3. Access and Use License
3.1 The purchase of a course or coaching program grants the Client a personal, non-transferable, and non-exclusive license to access the Materials for personal educational use only. 3.2 The Client may not:
Share, copy, or redistribute course materials;
Sell or commercially exploit the Materials;
Transfer login credentials or access to any third party. 3.3 Surf Academy Pro reserves the right to suspend or terminate access if misuse or unauthorized sharing is detected.
4. Payments and Refund Policy
4.1 All courses and coaching programs must be paid in full before access is granted. 4.2 All prices include VAT unless otherwise stated. 4.3 Surf Academy Pro offers a 30-day money-back guarantee from the date of purchase.
To qualify for a refund, the Client must contact Surf Academy Pro within 30 days of purchase.
Refunds are only available if the Client has completed less than 25% of the course content or has not yet received 1-on-1 coaching feedback. 4.4 No refunds are available after 30 days from purchase, or once substantial course materials or personalized coaching have been accessed. 4.5 The 30-days money-back guarantee is not applicable to discounted or special-deal purchases which means they are non-refundable unless stated otherwise.
5. Coaching and Communication
5.1 Personalized coaching is provided as part of certain programs through video feedback, calls, or digital messaging. 5.2 Clients must communicate respectfully and adhere to the communication guidelines provided. 5.3 Surf Academy Pro reserves the right to end coaching access in cases of harassment, disrespectful communication, or violation of terms, without refund.
6. Health and Safety Disclaimer
6.1 All content and coaching provided by Surf Academy Pro are for educational purposes only. 6.2 The Client acknowledges that surfing and physical training involve inherent risks. Surf Academy Pro and its Representatives are not liable for any injuries, damages, death, or losses incurred during practice, training, or surfing activities. 6.3 Clients should consult a medical professional before starting any exercise or surf fitness program.
6.4 Client recognizes that the information inside the platform is for entertainment purposes only and that the representatives are not qualified health experts, doctors or medical professionals but only share personal annecdotes and experiences. 6.5 Participation in any training or surf activity based on the Platform’s content is entirely at the Client’s own risk.
7. Intellectual Property and Media Rights
7.1 All course materials, videos, coaching resources, designs, and intellectual property on the Platform are owned by Surf Academy Pro and protected by copyright laws. 7.2 Clients may not copy, reproduce, or distribute any part of the Materials without written consent. 7.3 By submitting videos or other materials for coaching feedback, the Client grants Surf Academy Pro permission to use them (anonymously or with consent) for educational or marketing purposes.
8. Limitation of Liability
8.1 Surf Academy Pro provides the Platform and its contents “as is” without warranties of any kind. 8.2 Surf Academy Pro is not liable for:
Any physical, emotional, or material injury resulting from the use or misuse of the content;
Technical issues, downtime, or data loss;
Any indirect, incidental, or consequential damages. 8.3 The participant agrees that the total liability of Surf Academy Pro for any claim shall not exceed the amount paid by the Client for the relevant service.
9. Data Privacy
9.1 Surf Academy Pro respects your privacy and handles all data in accordance with applicable privacy regulations (including GDPR). 9.2 Personal information and videos are stored securely and will not be shared with third parties without consent, except where required by law.
10. Force Majeure
10.1 Surf Academy Pro shall not be held liable for delays or failure in performance resulting from causes beyond its reasonable control, including but not limited to internet outages, technical failures, natural disasters, or illness.
11. Governing Law
11.1 These Terms and Conditions are governed by Dutch law. 11.2 Any disputes shall be settled by the competent court in The Hague, the Netherlands.
